Welcome to the ProfiHitch Privacy Policy. We believe you deserve to understand exactly how your information is handled when you use our platform. This policy explains what we collect, why we collect it, how we protect it, and what control you have over it.

ProfiHitch, LLC ("ProfiHitch," "we," "us," or "our") respects your privacy and is committed to protecting your personal information.

This Privacy Policy explains how we collect, use, share, and protect your personal data when you use the ProfiHitch platform, website, mobile applications, browser extensions, and related services (collectively, the "Service"). By accessing or using the Service, you agree to the practices described in this Policy. If you are using the Service on behalf of an organization, you confirm that you have the authority to accept this Policy on its behalf.

1. Scope

This Privacy Policy applies to personal information collected through ProfiHitch's websites, mobile applications, browser extensions, and services. It does not apply to data collected through other channels such as offline interactions, other websites, or separate email communications not related to the Service.

2. Information We Collect

We collect information about you directly, automatically, and from third parties when you use the Service.

Definition of Personal Information:Personal information means any information that identifies, relates to, describes, or could reasonably be linked to an individual, directly or indirectly. This includes information you provide, data collected automatically, and information obtained from third parties.

A. Personal Information You Provide

We collect personal information that you voluntarily provide when you:

  • Create a profile or register for an account.
  • Submit a résumé/CV, job posting, or other content.
  • Complete a self-assessment, Career Love Language assessment, or other platform questionnaire.
  • with us via email, chat, or customer support.
  • Engage with any continuing education or training programs we offer.
  • Participate in community forums or surveys.

This may include:

  • Contact Details: Name, email address, phone number, mailing address.
  • Profile Information: Job title, qualifications, licenses, certifications, work history, résumé or CV, specialty, discipline, skills, patient population preferences, setting preferences, relocation preferences, compensation expectations, and public professional profile URLs (such as LinkedIn, Indeed, or Facebook).
  • Assessment Information: Responses to skill self-assessments, technical proficiency assessments, soft skill selections, and Career Love Language assessments.
  • Account Information: Username, password, preferences, visibility settings.
  • Billing Information: Payment details, processed through secure third-party payment providers. We do not store full payment card numbers on our servers.
  • Location Data: If you enable location services on your device, we may collect your precise location.

B. Automatically Collected Information

When you interact with the Service, we may automatically collect:

  • Device Information: IP address, browser type, device identifiers, operating system.
  • Usage Data: Pages viewed, features used, referral URLs, session duration, time on platform, search queries.
  • Cookies and Similar Technologies: See Section 9 for details on cookies and tracking.

C. Information from Third Parties

We may collect information from:

  • Social Media Platforms (Google, Facebook, LinkedIn) when you log in using those credentials.
  • Public Records for verification of licenses, certifications, or National Provider Identifier (NPI) status.
  • Partners and Vendors that assist with analytics, marketing, security, and platform operations.

D. Information Collected Through the Hitch List Feature

Staffing agencies that use ProfiHitch may identify a candidate's publicly available professional profile (such as a LinkedIn, Indeed, or Facebook profile URL) before that candidate registers with ProfiHitch. This is done through a browser extension that allows the staffing agency to save the public profile URL and their own internal notes to their ProfiHitch account.

Important: ProfiHitch does not collect, store, or process any personal information about you through the Hitch List feature unless and until you voluntarily register on the platform and enter a matching public profile URL in your ProfiHitch profile.

If you never enter a public profile URL during registration, or if the URL you enter does not match any staffing agency's saved list, no connection is made and no agency is notified.

3. How We Use Your Information

We use your information to operate, maintain, and improve the Service, including to:

  • Profile Matching: Suggest potential matches between Job Seekers and Employers based on skills, qualifications, and preferences.
  • Vrification:Confirm professional licenses, certifications, and credentials against public records before a profile becomes active on the platform.
  • Communication: Respond to inquiries, provide customer support, and send notifications related to your account or the Service.
  • Service Enhancement: Analyze usage trends to improve functionality and personalize the user experience.
  • Billing and Payments: Process payments for subscriptions, tokens, Hitch Coins, and other services via secure third parties.
  • Marketing Communications: Send you updates, job alerts, and promotions (you may opt out at any time).
  • Compliance and Fraud Prevention: Meet legal obligations and protect our platform from misuse.

4. Automated Decision-Making and AI Transparency

ProfiHitch uses AI-assisted algorithms to suggest matches between Job Seekers and Employers based on skills, qualifications, preferences, and Career Love Language responses.

AI tools support human decision-making but do not replace it. ProfiHitch does not make employment decisions on behalf of any party. All hiring decisions are made by the Employer, and all decisions about which roles to pursue are made by the Job Seeker.

You have the right to request information about how our matching algorithm uses your data and to request human review of any automated output that materially affects you. Contact privacy@profihitch.com to exercise this right.

5. How We Share Your Information

A. With Employers or Staffing Agencies

Job Seekers' profiles, résumés, and related information may be shared with Employers or approved Staffing Agencies in accordance with each Job Seeker's visibility preferences. Until a mutual match is confirmed, your identity, contact details, and employer history are not visible to Employers or Staffing Agencies. Your name, email, phone number, résumé, and assessment results are revealed only after a mutual match is confirmed and the Employer has spent a token to connect.

B. Hitch List 48-Hour Exclusivity Window

If you (1) have enabled staffing agency visibility in your privacy settings, and (2) voluntarily enter a public profile URL in your ProfiHitch profile that matches a URL previously saved by a staffing agency through the Hitch List feature, that staffing agency may receive a 48-hour exclusive window during which they are the only agency permitted to contact you through the platform.

After the 48-hour window expires, your profile becomes visible to other staffing agencies according to your general visibility preferences.

You remain in control at all times:

  • You may remove your public profile URL from your ProfiHitch profile at any time.
  • You may disable staffing agency visibility entirely in your privacy settings, which prevents any staffing agency from contacting you regardless of whether they saved your profile through the Hitch List feature.
  • You may request information about whether any staffing agency has saved your public URL and request that any such associations be severed. Contact privacy@profihitch.com.

C. With Third-Party Service Providers

We share personal information with trusted vendors who perform functions on our behalf, including:

  • Payment Processors for secure transactions.
  • Cloud Storage and Hosting Providers.
  • Analytics and Marketing Partners to improve the Service and deliver relevant content.
  • License and Credential Verification Services.

All third-party service providers are contractually bound to use your information only for the purposes we specify and to protect it with appropriate security measures.

D. For Legal and Compliance Purposes

We may disclose information to:

  • Comply with legal obligations or lawful requests such as subpoenas or court orders.
  • Protect our rights, property, or safety, and that of our users or the public.
  • Investigate and prevent fraud, security incidents, or violations of our Terms of Service.

E. Business Transfers

If ProfiHitch is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your personal information becomes subject to a different privacy policy.

F. Aggregate and De-Identified Information

We may share aggregate or de-identified data for research, analytics, or marketing purposes.

G. What We Do Not Do

We do not sell your personal information. We do not share your personal information with data brokers. We do not allow advertisers to target you based on sensitive health-related information.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service.

After account deletion, certain data may be retained for up to twelve (12) months to comply with legal obligations or resolve disputes, after which it is securely deleted or anonymized.

7. Your Privacy Rights

A. General Rights

Depending on your location, you may have the right to:

  • Access and receive a copy of your personal information.
  • Correct inaccurate personal information.
  • Request deletion of your personal information.
  • Request restriction of processing in certain cases.
  • Request portability of your data in a machine-readable format.
  • Object to certain uses of your information.
  • Withdraw consent at any time where processing is based on consent.

B. California Residents (CCPA and CPRA):

California residents have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act, including:

  • The right to know what personal information we collect and how it is used.
  • The right to request deletion of personal information.
  • The right to correct inaccurate personal information.
  • The right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under California law.
  • The right to limit the use of sensitive personal information.
  • The right to non-discrimination for exercising privacy rights.

C. European Union and United Kingdom Residents (GDPR and UK GDPR):

If you are located in the European Economic Area or United Kingdom, you have rights under the GDPR and UK GDPR, including:

  • The right to access, rectify, or erase your personal data.
  • The right to object to processing under certain circumstances.
  • The right to withdraw consent at any time.
  • The right to data portability.
  • The right to lodge a complaint with your local data protection authority.

D. Florida Residents

Florida residents may have rights under the Florida Digital Bill of Rights, including the right to confirm, access, delete, correct, and opt out of certain processing of personal data, as well as the right to opt out of targeted advertising and profiling.

We will not discriminate against you for exercising any of these rights.

8. Security of Your Information

We use physical, technical, and administrative safeguards to protect your information, including:

  • Encryption of sensitive data in transit and at rest where feasible.
  • Access controls that limit employee access to personal information.
  • Regular security reviews and testing.

However, no online system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

9. Data Breach Notification

In the event of a data breach affecting your personal information, we will notify you and applicable regulatory authorities as required by law. Notifications will include a description of the incident, the type of information involved, the steps we are taking in response, and recommended actions you can take to protect yourself.

10. Cookies and Tracking Technologies

We use cookies, web beacons, and similar technologies to:

  • Store your preferences and settings.
  • Enable secure logins.
  • Provide personalized content and job recommendations.
  • Analyze site traffic and performance.

You can manage cookies through your browser settings. Disabling cookies may limit certain features of the Service.

We honor Do Not Track signals where technically feasible and required by law.

11. Third-Party Links and Services

Our Service may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any third parties you access.

12. Children’s Privacy

Our Service is not intended for individuals under 18 years of age, and we do not knowingly collect personal information from children. If we become aware that we have collected such data, we will promptly delete it.

13. International Data Transfers

If you access the Service from outside the United States, your information may be transferred to and processed in the United States or other jurisdictions where we or our service providers operate. The United States may not provide the same level of data protection as your country of residence.

When we transfer data internationally, we use appropriate safeguards such as Standard Contractual Clauses to protect your information.

14. Use of Compensation Data

ProfiHitch collects and stores compensation data submitted by employers, including ranges marked as hidden, for the purposes of improving platform functionality, match accuracy, and labor-market insights. Hidden compensation data is not publicly displayed, shared with other users, or disclosed to third parties except as required by law or with explicit employer consent.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of material changes by posting the updated Policy on our website and, for registered users, by sending you an email.

Your continued use of the Service after such changes means you accept the revised Policy.

16. Dispute Resolution

If you have any concerns about our handling of your data, please contact us first at privacy@profihitch.com. We will attempt to resolve the issue in good faith.

If we cannot reach a resolution, you agree that any dispute will be resolved through binding arbitration in Broward County, Florida, as outlined in our Terms of Service.
